Overview

This website and online store is run by Zenya (“Zenya”, “we”, “us” or “our”). Our store is powered by Shopify. These Terms of service (the “Terms”) cover your use of our website, store and everything we offer through them, including the Zenya BuildUp Trainer and the Zenya 90-Day Transformation Program (together, the “Services”).

By visiting or buying from our store, you agree to these Terms and to our Privacy policy. If you do not agree, please do not use the Services.

Your account

To use the Services you must be of legal age where you live. Please give us accurate information, keep your login details safe and do not share or transfer your account. You are responsible for what happens on your account.

Our products

We do our best to show our products accurately, but colours and details can look slightly different on different screens. Product descriptions may change, and we may limit quantities or stop selling a product at any time.

The Zenya BuildUp Trainer is fitness equipment. It is not a medical device and is not meant to diagnose, treat, cure or prevent any condition. Results vary from person to person.

The 90-Day Transformation Program

The Zenya 90-Day Transformation Program comes free with every BuildUp Trainer and is only available to customers who buy one. We send it to you after your order.

The program is for your personal use. Please do not copy, share, resell or publish it. It is general fitness guidance for healthy adults, not medical advice. Start gently, breathe out as you squeeze and stop any exercise that hurts.

Orders

When you place an order, you are making an offer to buy. We may accept or decline any order for any reason. Your order is accepted once we confirm it and your payment has gone through. After that, we may not be able to cancel it.

Our products are for personal or household use, not for resale.

Prices and payment

Prices and offers can change at any time. You pay the price shown when you place your order, as confirmed in your order email. A sale price shows the previous price it was sold at and the saving. Taxes are added where they apply.

Shipping is free on orders over $60, or over £45 in the UK. Any other shipping cost is shown clearly at checkout, before you pay. If an offer has its own terms, those terms apply to that offer.

Please use accurate, up-to-date payment details. You confirm you are allowed to use the payment method you choose.

Shipping and delivery

Delivery times are estimates and can be affected by carriers, customs and busy periods. Once your parcel is handed to our carrier, it is on its way to you, and we will help if anything goes wrong. Details are in our Shipping policy.

Returns and our 60-day guarantee

Train 10 minutes a day with the program. If you don't feel the difference within 60 days of delivery, write to us and we'll give you your money back. No questions asked. How returns and refunds work is explained in our Return policy.

Our content

Everything on our website and in the program, including text, images, animations, videos, designs and logos, belongs to Zenya or is used with permission, and is protected by copyright and trademark laws. You may use it for your own personal, non-commercial use only. Please do not copy, change or share it without our written permission.

Reviews, messages and ideas

When you send us a review, comment, idea or photo, you give us permission to use it, without payment, including in our marketing. Please only send things that are yours to share and that are true. We may edit or remove anything we receive but do not have to.

Other websites and tools

Our site may link to other websites or use tools from other companies. We are not responsible for their content, products or practices, and you use them at your own risk.

Our relationship with Shopify

Zenya is powered by Shopify, which lets us run our online store. Any sale through our Services is made directly with Zenya. By using the Services, you agree that Shopify is not responsible for the Services or any sale, and you release Shopify and its affiliates from any claims, damages or liabilities related to them.

Privacy

How we collect and use your personal information is explained in our Privacy policy. Shopify may also collect some information about your use of the store, as described in its own privacy policy.

Mistakes

Sometimes our website may contain mistakes in descriptions, prices or availability. We may correct them, and update or cancel orders, at any time, even after you have placed an order.

What you must not do

Please use the Services only for lawful purposes. Do not break any laws, infringe anyone's rights, send false information, harass anyone, spread viruses or harmful code, scrape our site or try to get around our security. We may suspend or close your access if you do.

Ending these Terms

We may stop providing the Services, or end your access, at any time. Anything you owe us before then still has to be paid, and the parts of these Terms that should continue (such as our content, liability and governing law) still apply.

Our responsibility to you

The Services and products are provided “as is” and “as available”. To the fullest extent the law allows, we do not give any extra promises beyond those required by law, and we are not liable for indirect or consequential losses, such as lost profits or data.

Nothing in these Terms limits your legal rights as a consumer or our responsibility where the law does not allow it to be limited.

If you break these Terms

If someone makes a claim against us because you broke these Terms or the law, you agree to cover the costs that follow, as far as the law allows.

The small print

If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we can still do so later. These Terms and our policies are the whole agreement between you and us. We may transfer our rights under these Terms; you may not transfer yours without our written permission. Headings are only there to help you read.

Governing law

These Terms are governed by the law of the country where Zenya is based. Where the law of your country gives you extra rights or lets you go to your local courts, you keep those rights.

Changes to these Terms

We may update these Terms from time to time. The current version is always on this page, with the date it was last updated. If you keep using the Services after a change, the new Terms apply.
